Are Foreign Citizens Allowed to Buy Agricultural Land in Russia?

All over the world, the countries are gradually running out of fertile land. And those land plots that are still available for sale cost so much that not every investor is ready to risk his finances. In Russia, agricultural land is fertile, the cost is several times cheaper than in the European Union, large blocks of land can still be found on sale.

Purchasing agricultural land in Russia guarantees 12-30% income per year. However, the sales transaction involves some difficulties. According to the Russian law, registration of an agricultural plot by foreign citizens is impossible. But you can do the following:

  • Оpen a legal entity in Russia, and it will legally acquire land with our help;
  • Buy the current agricultural business in Russia with the land (you can buy a company that has nothing but agricultural land);

More and more foreign investors from the USA, Germany, Canada, India, Australia, China, and Latin America become interested in buying agricultural land. Currently, more than 20% of agricultural land in the Central part of Russia is owned by foreign companies.

Foreign private investors want to create an agricultural enterprise in Russia or invest in the undervalued Russian lands. Buying agricultural land brings from 12 to 30% of income per year. This became especially relevant after the introduction of retaliatory sanctions and import substitution program in Russia, which significantly increased the demand for agricultural land. Many law firms or attorneys that are not specialized in Russian land law often give unqualified advice on the acquisition of agricultural land by foreign investors. Most often, they just recommend a long-term land lease agreement presupposing the rent of the plot from the state during 49 years. According to the legislation of the Russian Federation, namely Article 3 of the Federal Law No. 101-FZ from July 24, 2002 (as amended on July 15, 2016) “On the Turnover of Agricultural Land”, a foreign citizen can buy agricultural land, registering it for the legal entity.
